Welcome to Talixi. These Terms and Conditions ("Terms") govern your access to and use of the Talixi platform, including our website, applications, and AI-powered learning services (collectively, the "Service"). By accessing or using Talixi, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Talixi, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years of age to use Talixi. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service. By using Talixi, you represent and warrant that you meet these eligibility requirements.

Talixi uses artificial intelligence to generate educational courses and content. You acknowledge and agree that:

• AI-generated content is provided for educational purposes and may not be 100% accurate, complete, or up-to-date
• You should verify important information from authoritative sources before relying on it
• AI-generated content does not constitute professional advice (legal, medical, financial, or otherwise)
• We are not liable for any decisions made based on AI-generated content

4.2 Gamification Features

Talixi includes gamification features such as XP points, streaks, achievements, and leagues. These features are for motivational purposes only and have no monetary value. We reserve the right to modify, reset, or remove gamification elements at any time.

4.3 Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

5. User Conduct

When using Talixi, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others, including intellectual property rights
• Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated means (bots, scrapers, etc.) to access the Service without our express permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, redistribute, or commercially exploit the Service without authorization
• Impersonate any person or entity

6. Intellectual Property

The Service, including its original content (excluding user-generated and AI-generated content), features, and functionality, is owned by Talixi and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

6.2 AI-Generated Course Content

Courses generated by our AI are provided for your personal, non-commercial educational use. You may not reproduce, distribute, or create derivative works from AI-generated courses for commercial purposes without our permission.

6.3 Your Content

You retain ownership of any content you create or upload to Talixi. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be accurate, reliable, or complete
• Any errors in the Service will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Talixi and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

12. Governing Law

14. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Talixi.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Talixi regarding your use of the Service and supersede all prior agreements and understandings.
